Zenvora Terms & Conditions

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Zenvora: the company offering products and/or services via the website www.zen-vora.com, reachable via the email address info@zen-vora.com.

  • Consumer: the natural person who does not act in the exercise of a profession or business and enters into an agreement with Zenvora.

  • Agreement: an agreement between Zenvora and the consumer, to which these terms and conditions apply.

  • Products: the goods and/or services offered by Zenvora through its platform.


Article 2 – Applicability

These terms and conditions apply to every offer, quotation, order, and agreement of Zenvora, unless otherwise agreed in writing.

By placing an order with Zenvora, the consumer agrees to the applicability of these terms and conditions.


Article 3 – Offers and Quotations

All offers by Zenvora are non-binding, unless a term for acceptance is stated in the offer itself.

Zenvora cannot be held to its offers or quotations if the consumer could reasonably understand that the offer or quotation, or part of it, contains an obvious mistake.

Prices in the offers include VAT, unless stated otherwise.


Article 4 – Agreement

The agreement is concluded at the moment Zenvora accepts the consumer's order.

Zenvora confirms receipt of the order via email. The consumer has the right to withdraw from the order within 30 days after receiving the confirmation.


Article 5 – Prices and Payment

The prices of the products are the prices published on Zenvora's website, including VAT.

Payment must be made via the payment methods offered on the website. Payment must be completed within 7 working days after the order confirmation.

If payment is not received on time, Zenvora may cancel the order.


Article 6 – Right of Withdrawal

The consumer has the right to withdraw from the agreement within 30 days after receiving the product without providing a reason.

The consumer must return the product unused, undamaged, and in the original packaging to Zenvora. Return shipping costs are the responsibility of the consumer, unless otherwise stated.


Article 7 – Delivery

Zenvora strives to deliver orders within 30 days, unless otherwise agreed.

Delivery is made to the address provided by the consumer. Zenvora is not responsible for delays outside its control.

If delivery is not possible, Zenvora will make efforts to provide a replacement product. The consumer will be informed accordingly.


Article 8 – Warranty and Liability

Zenvora provides a warranty on its products in accordance with the law and its warranty conditions.

Zenvora is not liable for damage resulting from misuse or improper installation by the consumer.


Article 9 – Privacy

Zenvora respects its customers’ privacy and processes personal data in accordance with applicable laws and its privacy policy.

Personal data is used only for processing orders and improving services.


Article 10 – Intellectual Property

All intellectual property rights on the products, services, and content of Zenvora’s website remain the property of Zenvora or its licensors. The consumer may not reproduce, distribute, or disclose these materials without permission.


Article 11 – Delivery and Execution

Zenvora shall exercise the greatest possible care in receiving and executing product orders.

Delivery takes place at the address provided by the consumer.

Accepted orders will be executed promptly, but no later than 30 days unless the consumer agreed to a longer delivery period. If delivery is delayed or cannot be executed fully, the consumer will be informed no later than 30 days after placing the order. The consumer may terminate the agreement without costs and is entitled to any compensation.

In case of termination, Zenvora will refund the amount paid by the consumer as soon as possible, but no later than 14 days after termination.

If delivery of a product is impossible, Zenvora will make efforts to provide a replacement product. Consumers will be informed clearly at delivery. Return rights cannot be excluded for replacement items, and return shipping costs will be covered by Zenvora.

The risk of damage and/or loss of products rests with Zenvora until delivery to the consumer or a designated representative, unless otherwise agreed.


Article 12 – Duration Transactions: Duration, Termination, and Renewal

Termination:
Consumers may terminate agreements for indefinite periods, which concern the regular delivery of products or services, at any time with a notice period of no more than one month.

Fixed-term agreements may also be terminated at the end of the fixed period with a notice period of no more than one month.

Renewal:
Fixed-term agreements may not be automatically extended or renewed unless explicitly allowed. Exceptions apply for periodicals (daily, weekly, monthly publications) with a maximum automatic extension of three months, with a notice period of one month.

Duration:
If an agreement lasts more than one year, the consumer may terminate it after one year with a notice period of one month, unless fairness prevents early termination.


Article 13 – Payment

Unless otherwise agreed, amounts owed by the consumer must be paid within 7 working days after the 30-day withdrawal period starts.

Consumers must immediately report incorrect or incomplete payment information to Zenvora.

In case of non-payment, Zenvora may charge reasonable costs previously communicated to the consumer, within legal limits.


Article 14 – Complaints

Complaints about the execution of the agreement must be submitted clearly and fully within 7 days of discovering the issue.

Zenvora will respond to complaints within 14 days.


Article 15 – Disputes

Dutch law applies exclusively to agreements between Zenvora and the consumer, even if the consumer resides abroad.

Disputes that cannot be resolved amicably may be submitted to the competent court in the Netherlands.


Article 16 – CESOP

Due to new measures in 2024 related to the 'Amendment of the Turnover Tax Act 1968 (Implementation Directive for Payment Service Providers)', payment service providers may register data in the European CESOP system. Zenvora will process these data in accordance with the law.


Article 17 – Amendments to Terms & Conditions

Zenvora reserves the right to amend these terms and conditions at any time. Amendments take effect from the moment they are published on the website, unless stated otherwise. Consumers are deemed aware of the updated terms after publication.
